BrixPort is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

These Terms and Conditions ("Terms") govern your access to and use of the BRIXPORT
INNOVATION LTD e-commerce platform (the "Platform"), website, and mobile application,
and all related services (collectively, the "Services").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not
agree, you must not use the Platform.

1. About Us
BRIXPORT INNOVATION LTD is a company incorporated in Ghana. We operate an ecommerce platform specializing in building materials, construction supplies, and related accessories such as cement, roofing sheets, tiles, paints, plumbing materials, electrical
fittings, tools, and other construction products.

2. Eligibility
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
that you have the legal capacity to enter these Terms. The Platform may be used by both
individual builders, contractors, and businesses.

3. User Accounts
• You may need to create an account to place orders or access certain features.
• You are responsible for keeping your account information accurate and your
password confidential.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Products and Orders
• All products listed are building materials and accessories. Product images,
descriptions, and specifications are for illustration purposes only and may vary
slightly from the actual product.
• We reserve the right to modify prices, discontinue products, or correct errors
without prior notice.
• Placing an order constitutes your o]er to purchase. We reserve the right to accept or
reject any order for any reason, including product availability, errors in pricing, or
suspected fraud.
• Bulk orders and large quantities may require separate quotation and confirmation.

5. Pricing and Payment
• All prices are in Ghana Cedis (GHS) and inclusive of applicable taxes unless
otherwise stated.
• We accept payments via Mobile Money (MTN, Vodafone, AirtelTigo), bank transfers,
and other approved methods.
• Full payment is required before processing and delivery of orders.
• Prices for building materials are subject to market fluctuations. Confirmed orders
will be honored at the price at the time of confirmation.

6. Shipping and Delivery
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

7. Returns, Replacements & Cancellations• All goods sold on the Platform are non-refundable. We do not o]er money-back
refunds under any circumstances.
• Returns are accepted only for replacement (exchange) products.
• Replacement requests must be made within 7 days of delivery and are subject to
the following:
• The product must be unused, in its original packaging, and in the same condition as
delivered.
• The issue must be due to wrong item delivered.
• We reserve the right to inspect all returned items before approving any replacement.
• Replacements will not be accepted for change of mind, incorrect measurements,
color preference, or customer ordering errors.
• The following items are non-returnable and non-replaceable:
• Customized or cut-to-size materials (e.g., cut tiles, fabricated items)
• Perishable or chemical products (e.g., paints, adhesives, sealants – once opened)
• Bulk loose materials (e.g., sand, gravel, cement – if already delivered)
Return shipping and handling costs for replacement requests shall be borne by the
customer unless the error was caused by BRIXPORT INNOVATION LTD.

8. Intellectual Property
All content on the Platform, including logos, product images, descriptions,
belongs to BRIXPORT INNOVATION LTD or its licensors. You may not copy, reproduce, or
use any content without our written permission.

9. User Conduct
You agree not to:
• Use the Platform for any illegal purpose.
• Submit false or misleading information regarding orders or product reviews.
• Attempt to manipulate prices or interfere with other users.
• Engage in any activity that could damage, disable, or impair the Platform.

10. Disclaimers
The Platform and all products are provided “as is”.
• We do not guarantee that building materials will be suitable for every specific
construction project. Customers are responsible for verifying product suitability,
measurements, and compliance with local building regulations.
• Product performance may vary depending on usage and environmental conditions.

11. Limitation of Liability
To the maximum extent permitted by Ghanaian law, BRIXPORT INNOVATION LTD shall not
be liable for any indirect, consequential, or punitive damages. Our total liability shall not
exceed the total amount paid by you for the specific order in dispute.

12. Indemnification
You agree to indemnify and hold harmless BRIXPORT INNOVATION LTD, its directors,
employees, and partners from any claims, losses, or damages arising from your breach of
these Terms or misuse of the Platform.

13. Termination
We may terminate or suspend your access to the Platform at any time for violation of these
Terms or for any other reason.

14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Republic of Ghana. Any disputes shall
first be resolved amicably. Failing which, the dispute shall be submitted to the courts of
Ghana.

15 - RELATIONSHIP WITH SHOPIFY
BrixPort is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with BrixPort. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and BrixPort, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BrixPort. 

16. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after
changes constitutes your acceptance of the new Terms.
